LETsure - LEGAL PROTECTION INSURANCE - What is LETsure
Legal Protection Insurance?
LETsure Legal Protections Insurance is a comprehensive legal protection policy for
homeowners or Landlords letting their residential property. The policy is available to any
Landlord, private individual or company who lets property under the Housing Acts as
defined in main condition 1 below.
LETsure Legal Protection will:
1: - Cover legal costs in disputes with tenants or
other unauthorised occupants over unpaid rent or damage to the building or contents and
will also cover the cost of the removal of squatters.
2: - Pay the cost of hotel accommodation up to a limit
of £50.00 per day for you and your family for up to 30 day's whilst legal action to
remove the tenant or squatter is started. LETsure pays all legal fees up to £50,000 per
claim to protect your legal rights.
3: - Automatically provide a legal service for the
recovery of any outstanding rent or damages. In all cases the minimum amount in dispute
must be at least £250.00 at all times.
MAIN CONDITIONS
1: - The Letting Agent or Landlord of the property must
have a tenancy agreement which must be in writing and either: (A) an
Assured Tenancy or Assured Shorthold Tenancy within the Housing Act of 1988 (as amended by
the Housing Act 1996) or any other amendments to that Act or equivalent legislation which
applies within the territorial limits, or (B) a tenancy agreement with
the tenant in which the tenant is a Limited Company or where the annual rental exceeds
£25,000, or (C) a Short Assured Tenancy or Assured Tenancy as defined in
the Housing (Scotland) Act 1988 and any re-enactment's or amendments thereof or a Tenancy
Agreement in which the tenant is a Limited Company. In Northern Ireland the agreement
between the landlord and the tenant to let the property must not be a Protected Tenancy or
a Statutory Tenancy within the meaning of the Rent (NI) Order 1978 nor a Protected
Shorthold Tenancy within the meaning of the Housing (NI) Order 1983 (and any enactment's
thereof) or a Tenancy Agreement in which the tenant is a Limited Company.
2: - It is the responsibility of the Letting Agent or
Landlord to thoroughly vet EACH prospective tenant. An acceptable LETsure Comprehensive
Tenant Assessment will meet all the reference requirements of the LETsure Legal Protection
Insurance. In the event of a claim a copy of the Tenant Assessment must be supplied or
alternatively a minimum of two (2) satisfactory written references including a financial
reference must be provided. A minimum of one (1) month's rent must must be collected as a
deposit prior to commencement of the tenancy.
3: - This Policy can cover a property which is already
let but in such cases there will be no cover for a dispute with the tenant for the first
three months of the first period of insurance. This condition does not apply to the
policies issued to renew cover under a previous Legal Protection Policy. Full cover
applies for disputes with any tenant who occupies the property on or after the Policy
inception date.
4: - As with all forms of insurance this Policy will
not cover an existing dispute.
5: - The property to be covered must be in Great
Britain.
MAKING A CLAIM - All claims must be notified in writing
to The Property Management Group and claim forms can be obtained
from us either by Post, Fax, Telephone, E-mail or On-Line. A claim for the recovery of
unpaid rent must be notified within 60 day's from the day the rent was first due
and payable. Claims for any other dispute which may give rise to legal
proceedings must be notified immediately.
